Terms of Service

These terms govern your use of FounderKit. They are written to be read — if a clause is unclear, ask us rather than guessing.
Agreement
By creating an account you agree to these terms. If you are accepting on behalf of a company, you confirm you are allowed to bind it.
What FounderKit is
An AI workspace for founders: a mentor that pressure-tests your idea, live market research, an offer builder, a waitlist page, a brand kit and a pitch deck builder.
It is a tool, not an adviser. FounderKit does not provide legal, financial, investment, tax or accounting advice. Nothing it produces is a recommendation to raise money, spend money or sign anything. Decisions about your business are yours.
Accounts
Keep your credentials secure and tell us promptly if you think someone else has access. One account is for one person; sharing logins is not permitted. You must be 16 or over.
Plans, credits and payment
- Free, Pro and Scale plans are described on the pricing page. Paid plans renew automatically each period until cancelled.
- AI actions consume credits. Your plan's allowance is added each billing period. Unused credits do not roll over — each period starts at the plan allowance.
- Purchased top-up credits do not expire while your account is open, and are used only after the period allowance is spent.
- Credits have no cash value and cannot be exchanged for money or transferred between accounts.
- If an AI action fails on our side, the credits are returned automatically. If it succeeds but you dislike the output, it has still been spent.
- Payment is handled by Stripe. Prices are in US dollars and exclude any tax you may owe locally.
- We may change prices with at least 30 days' notice by email. The new price applies from your next renewal, so you can always cancel first.
Cancelling
Cancel any time from Settings → Manage billing, which opens Stripe's portal. Cancellation takes effect at the end of the period you have already paid for; you keep full access until then, and are not billed again. We will not make you email us to cancel.
Who owns what
You own your content — your ideas, venture data, offers, decks and everything you enter or generate. We claim no ownership of it.
You grant us only the licence needed to run the service: to store your content, display it back to you, and send the relevant parts to our AI providers so they can respond. Nothing more.
We own FounderKit itself — the software, design, prompts and brand.
AI output is not unique to you. Another user with a similar idea may receive similar output, and we cannot promise anything generated is original or free of third-party rights. Check before you rely on it commercially, particularly for names and logos.
Acceptable use
You agree not to:
- break the law, or use the service to harm, defraud or harass anyone;
- upload personal data about other people without a lawful basis, or send waitlist email to people who did not opt in;
- attempt to bypass credit limits, rate limits or payment, or probe our systems without permission;
- resell or white-label FounderKit as your own product;
- use automated means to extract data or generate load beyond normal use.
We may suspend an account that breaches this. Where the breach is not serious we will warn you first.
Your waitlist visitors
If you publish a waitlist page, you are responsible for what you ask, what you promise and how you use the answers — including telling signups what you are collecting and honouring their requests. You agree to cover us for claims arising from how you handle that data.
Availability
We aim for FounderKit to be available whenever you need it, but we do not guarantee uninterrupted service. We rely on third parties — hosting, database and AI providers — and their outages become ours. We may change or discontinue features; if we remove something you actively use on a paid plan, we will tell you and refund the unused portion.
Disclaimers and liability
The service is provided "as is". To the extent the law allows, we exclude implied warranties, and we are not liable for lost profits, lost data, lost business opportunity or indirect losses.
Our total liability to you in any twelve-month period is capped at what you paid us in that period. Nothing here limits liability for death, personal injury, fraud, or anything else that cannot lawfully be limited.
Specifically: we are not liable for business decisions you take based on AI output, including market research, competitor analysis or anything in a generated pitch deck. Verify anything that matters.
Ending the agreement
You may close your account at any time. We may terminate for a material breach of these terms, or with 30 days' notice for any reason — in which case we refund the unused portion of what you paid. On termination you can export your data for 30 days, after which it is deleted.
Changes to these terms
We will email you at least 30 days before any material change. Continuing to use FounderKit after that means you accept the new terms; if you do not, cancel before they take effect and we will refund the unused portion.
